Long version of the privacy statement and FAQs

Compliance with German and European data protection regulations is given the highest priority at etracker. We are the first web controlling company to have been awarded certification of compliance with data protection regulations. We gained this certification in 2006 after an extensive assessment procedure by Hamburg’s data protection officer. All data is processed in full compliance with European and German data protection laws. That is something of which we are extremely proud!

In addition to our compliance with legislation, it is also very important that we apply voluntary internal checks and, in this way, also follow the guidelines issued by recognized authorities on data protection. Furthermore, in 2008 we joined the Hamburg Association for the Promotion of Data Protection, and signed up to the data protection initiative “Wir Speichern Nicht” (“We do not log your data”).

In order to meet our own standards and give you the assurances that you have access to the best information, we have provided the answers to the key questions concerning etracker and data protection below.

1. What data does etracker store?

We store two basic types of data:

Firstly, we store contact data relating to our customers and to service providers with whom we have a business relationship, now or potentially in the future. This data is called “customer data”.

Secondly, we also store “user data” on our website, on behalf of our customers. This user data is collected when people visit our customers’ websites or our own website.

2. How does etracker store data?

To answer this question we need to provide a bit of extra information. Data protection law distinguishes between two types of data: personal data and non-personal data.

a) Non-personal data

Non-personal data includes all information that is collected, processed and stored anonymously, and that cannot be traced back to a particular person. In particular, non-personal data includes the majority of the user data mentioned above. Such information comprises, for example, aggregated key figures such as the average time spent on a page, the frequency with which a page has been visited and the contents of shopping baskets. It comprises no data with which it would be possible to identify a particular individual. Data about individual users may also be stored under a pseudonym that cannot be used to determine any relevance to a specific person. In terms of user data, user’s IP addresses and domain information in particular are stored in an abbreviated form, so that it is not possible to identify individual users. We guarantee that we do not combine any IP addresses that we have collected with any other data, for example to identify a person.

b) Personal data

Information that can identify a person is collected under personal data. This category includes, in particular, the aforementioned customer data which may include details given such as company, name, address, telephone number or e-mail address.

We guarantee that we only collect personal data in accordance with the relevant legal specifications. This means that personal data is only stored in our customer database within the terms of the contract and this is, of course, not passed on to third parties. etracker only uses personal data for advertising and market research purposes if it has the express permission of the individual first. Within the terms of the Telemedia Act (Telemediengesetz; TMG), we are, of course, able to provide you with information on your personal data which we hold at etracker.

3. Can I refuse the storage of data?

You may revoke storage of personal data at any time. Regardless of legal regulations, your data will then be deleted/blocked with immediate effect. This is done in so far as the information is not required by us to fulfil our obligations towards you. It can also be done retrospectively for all your personal data stored in the past.

You may also refuse the collection and storage of non-personal usage data by etracker at any time, including with future effect. In this case, no user data from your browser will be stored during any future visits to our website. To refuse storage of your user data click here.

4. Does etracker pass data on to third parties?

No, we do not pass on any data to third parties. An exception to this is when authorized state bodies request such information, for example law enforcement authorities, which are called on if our terms/services are abused in any way.

Furthermore, the user data stored on behalf of our customers belongs exclusively to the respective customer, in so far as the user data has not been compiled with one of our Lite products. In addition to this, we do not use this data to compile internal statistics, calculate industry averages or track users across several customer websites, unless we have prior permission to do so.

5. Does etracker process data abroad?

We operate a European data center in Hamburg, Germany. We guarantee compliance with the data protection standards stipulated by German legislation and by the European Community in terms of data storage. We also offer our overseas customers the option, if requested, of storing data in our US-based data center.

We reserve the right to operate servers at sites outside the European Community. Compliance with the aforementioned protection standards also applies in this case. If customer data is stored on servers outside the European Community, we will inform you of this and ask for your agreement first.

6. What about technical data protection at etracker?

The operation of complex technological infrastructure is one of our key areas of expertise and an essential component of our service. It is, therefore, a priority for us that our data centers are always operated according to the latest security standards. These include the latest firewall and intrusion detection technologies as well as extensive physical controls and access restrictions to our data center. At an application level, there are also modern authentication methods for user and administrator authorization, and we keep daily backups of all data, which is archived decentrally. In addition to this, Secure Socket Layer (SSL) data transfer is always used for collecting personal data. All information transferred with this method is encrypted before it is sent. This transfer technology is supported by the latest browsers, so it is, therefore, advisable to regularly update your browser.

7. What about organizational data protection at etracker?

At etracker, employees undertake to observe confidentiality and this is just as important as the use of the latest security technologies. All employees have been informed of the procedure for handling personal data and are obliged, in writing, to observe data confidentiality in accordance with Section 5 of the German Federal Data Protection Act (Bundesdatenschutzgesetz; BDSG) and communications confidentiality in accordance with Section 85 of the German Telecommunications Act (Telekommunikationsgesetz; TKG). These obligations and requirement for confidentiality also apply after employment has ended.

8. How do I inform visitors to my website that etracker is used?

So that your users are clearly aware of the use of etracker technology on your website, we advise that you post the following, or similar, wording on a prominent position on your website. This wording also applies to this website.
