Tip of the Week: Data protection notice

Data protection notice & right to object

Regardless of whether you use etracker Analytics in the standard version without cookies or in the hybrid version with cookies, the use of etracker must be indicated in your data protection statement in order to comply with the requirements of the GDPR regarding the legal basis of legitimate interest (Art. 6 (1f)). Only then you are allowed to waive the consent for tracking.

Even if you can waive the consent for tracking, the possibility to object must be given according to Art. 21 (1) of the GDPR. There it says: „The data subject shall have the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her which is based on point (e) or (f) of Article 6(1), (…) “

etracker provides a sample text including an objection option that you can easily integrate into your privacy policy. You can find the text directly in your etracker account. Log in and go to: Settings → Privacy → Data protection notice and right to object.

With the help of the slider, the user can exercise his or her right to object to exclusion from the tracking.  By default, the slider is set to include the visit data in the counting:

When the user moves the slider, the slider changes and the exclusion takes place from the next page view:

Why is the slider not always displayed?

If the slider is not displayed after inserting the objection option provided by us, please check whether the etracker code is implemented correctly on the corresponding page.

If this is the case and the slider is not displayed or cannot be activated, no tracking has taken place. Reasons for this are:

  • Adblocker or other addons such as Ghostery.
  • DNT setting in the browser
  • Security settings in the browser profile (Firefox and Edge especially)
  • JavaScripts are blocked by the browser
  • Other (physical) blockers

In addition to the offered slider, you can also design the exclusion of the counting individually. This is particularly useful if you want to adapt the slider or button more closely to your web design or if you want to offer other language variants in addition to German and English. You can find the instructions for this at: https://www.etracker.com/en/docs/integration-setup-2/settings-accounts/objection-alternatives/
